  • EasyGroup Loses Trade Mark Battle as UK IPO Revokes 'easyOffice' Rights

EasyGroup Loses Trade Mark Battle as UK IPO Revokes 'easyOffice' Rights

In a significant ruling by the UK Intellectual Property Office, EasyGroup Ltd has suffered a legal setback as four of its ‘easyOffice’ trademarks have been revoked following a challenge by Nuclei Ltd. The decision, issued under the Trade Marks Act 1994, found that EasyGroup failed to demonstrate genuine use of the marks across various business sectors, including telecommunications, financial services, and office rentals. Despite EasyGroup’s claims that its trademarks had been actively used, the evidence provided was deemed insufficient, leading to the cancellation of the marks from their respective revocation dates, the earliest dating back to 2009. The ruling follows prolonged legal proceedings and reinforces the principle that trademark protection hinges on demonstrable commercial use. The following table provides detailed information on all revoked ‘easyOffice’ trademarks, including their final revocation dates.

Michael Kors Triumphs in EU Trademark Dispute Against ‘MK Mike Kemi’

In a ruling by the European Union Intellectual Property Office (EUIPO), luxury fashion giant Michael Kors has successfully blocked the registration of the contested trademark ‘MK Mike Kemi,’ citing a likelihood of confusion. The Opposition Division found that the striking similarities between the two marks—particularly the dominant ‘MK’ lettering enclosed in a circular frame—could mislead consumers into believing the brands were connected. The decision determined that the identical nature of the goods, combined with the strong visual resemblance of the marks, heightened the risk of association. The ruling also noted that while ‘Mike Kemi’ introduced an additional verbal element, it did not sufficiently differentiate the contested sign from the well-established Michael Kors branding. Following visualisation shows a comparison of the original and contested trademarks, highlighting the similarities that led to the decision.
